Two Die in Drunk Driving Accident in Dallas

At 2:30 a.m. last Friday morning Joseph Macias, suspected of driving under the influence of alcohol, drove southbound on the northbound lanes of Interstate 45 with disastrous consequences. Near the intersection of Loop 12, Macias’s red Ford F-150 pickup truck collided with a Nissan truck carrying Luis Alvarado and his passenger, Jose Aguiluz-Coreas, killing them both. Macias, who has a history of driving intoxicated, survived.

Driving under the influence of alcohol kills more than 3,000 Texans every year. In fact, Texas is infamous for having the highest number of drunk driving fatalities nationwide.

Under the law, there’s simply no excuse for driving under the influence. If you’ve been in an accident with a driver who’s been drinking, your first call should be to the police. Your second should be to the personal injury experts at Fears | Nachawati. Call us at 1.866.705.7584 or send an email to info@fnlawfirm.com. We can help you today!

Unmarked Gas Lines Threaten North Texans’ Safety

It’s understandable to think that energy companies would clearly mark and map the natural gas pipelines which criss-cross North Texas. After all, state law requires it. However, numerous accidents in recent months suggest that natural gas pipeline companies may have failed to appropriately mark their subterranean work and that the Texas Railroad Commission may be shirking its duties. As a result, North Texas landowners and workers are at risk of striking an unmarked pipeline when excavating.

If you own land that’s littered with unmarked natural gas pipelines or if you’ve suffered an injury as a result of improperly marked and mapped pipes, you may have a case against the energy company or companies responsible for the proper laying, marking and mapping of pipe. To find out what steps you should take, contact the experienced, expert attorneys at Fears | Nachawati. We can advise you and the consultation is free. Addison Four-Year-Old Falls 40-Feet from Fifth Floor of Apartment Building

Ms. Lisa Bell’s little girl is fighting for her life at Children’s Medical Center Dallas after a 40-foot fall from the top floor of Addison’s Savoye at Vitruvian Park. While playing with other children, the four-year-old child, whose name has not been released, fell out of an open, fifth-floor window to the ground below.

Without question, attentive parents are the first line of defense against accidents involving children. However, it’s also important to investigate whether the premises – in the Lisa Bell case, the apartment complex – were safe for residents. To make a definitive inquiry, experts are often needed. If you’ve been involved in an accident that involves the safety of the premises, you should contact the injury experts at Fears | Nachawati. Rolling Blackouts Leave Dallas Citizens Irate, Injured

Extreme winter weather in North Texas surprised many residents, including one group in particular who should have been prepared: Dallas electricity producers. As a result, when North Texans most needed electricity, there wasn’t enough to go around. Moreover, some of the people who most deserved and needed electricity – doctors and patients – were those who went without. In fact, twenty dialysis patients had to have their blood hand-cranked back into their bodies and doctors in surgery had the lights suddenly go out.

Were you affected by the rolling blackouts? If so, you might have a valid claim against your electricity provider. The expert attorneys at Fears | Nachawati can advise you and the consultation is free. So, give us a call at 1.866.705.7584 or send an email to info@fnlawfirm.com. We can help you!

Car Driver Strikes, Kills Pedestrian in Irving

Late last week, a man was struck and killed by a car on Airport Freeway in Irving, Texas. Witness reports suggest that the pedestrian ran in front of the vehicle, however, the investigation into the accident continues.

Many Americans believe that the adage “pedestrians have the right of way” is always true. However, that’s not the case. For many well-known roads, pedestrians do not have the right of way. Moreover, even in situations in which pedestrians do have the right of way, drivers are not necessarily liable for a pedestrian’s injury. If a pedestrian puts a driver in a situation where it is unthinkable or physically unreasonable to expect a change in course or reduction of speed, the court will usually shield the driver from liability.

Pedestrian liability is can be a difficult, confusing and expensive area of the law. You need experts who understand the law’s full complexity. You need the experts at Fears | Nachawati. Texas Judge Orders Investigation of Toyota Motor Corp. for Legal Misconduct

Did Toyota Motor Corp. intentionally hide evidence during a 2006 lawsuit brought by a victim of a negligently designed Camry? Dallas drivers – which include thousands of Camry drivers and tens of thousands of Toyota drivers – are particularly interested in this question. Fortunately for them, Texas District Judge John E. Neill is interested in this question, too. In fact, just last week Judge Neill appointed an independent counsel to investigate the issue and gave him the power to probe whether Toyota violated a court order in the case, which settled for $1.5 million.

Judge Neill’s step is unusual, but it’s not unprecedented. Products liability is important – and tampering with evidence and short-circuiting the discovery process in violation of a court order is of even greater concern. In fact, these proceedings could have significant impact on the way hundreds of claims against Toyota are handled.

If you own a Toyota and have a product liability concern, you need to contact the product liability and legal malpractice attorneys at Fears | Nachawati. We know how to fight for your rights and to protect you against corporate attorneys who refuse to play within the rules. Call 1.866.705.7584 or send an email to info@fnlawfirm.com. We can help!

If Someone Fell in Your Home or Office Would You Be Liable?

Premises liability is an important legal concept. Courts have found that property owners have an obligation to ensure that their land is free from hazards and dangerous conditions. Despite this standard, many property owners are unaware or indifferent to their legal liability for the premises they control. Premises liability can arise from any number of hazardous conditions, including cracked steps, uneven pavement or flooring, ice, wet floors, leaks, insufficient lighting, lack of warning signs and lack of security.

You are responsible for the condition of your home and office. If you’re concerned about the extent of liability which you might face in the event of an accident occurring on your premises, you should contact the injury experts at Fears | Nachawati immediately. For a consultation, give us a call at 1.866.705.7584 or send an email to info@fnlawfirm.com.

A national basketball recruit with a bright future in college, Davion Houston should have celebrated his 18th birthday this year. Instead, his parents are mourning his untimely and tragic loss at the hands of a Union Pacific train.

Last week, Mr. and Mrs. Houston filed a wrongful death lawsuit against Union Pacific for their son’s medical costs, future earnings and emotional distress. They describe their son’s death as entirely avoidable. In their brief, the Houstons explain that Davion’s car was struck by a Union Pacific train at an unmarked intersection. Moreover, the Union Pacific train engineer failed to blow the train’s whistle, indicating its approach.

If a loved one has died at the hands of someone else’s negligence, you can do something about it. Take the time today to speak to a Fears | Nachawati expert about how a wrongful death lawsuit. Call us at 1.866.705.7584 or send an email to info@fnlawfirm.com.

Dallas Demographics Suggest Dangerous Trend

According to Pinpoint Demographics, Dallas, Texas, now has the third largest number of physician’s offices per capita nationwide. As Dallas County Medical Society past president Dr. Stephen Ozanne explained recently, “Texas has become a popular place for physicians to practice as a result of tort reform passed in 2003, which has greatly lowered cost of malpractice insurance and provided a less adversarial medico-legal climate.”

Dr. Ozanne may be right, but he what he fails to say is that Texas tort reform constrained an important remedy—the courts—for victims of medical malpractice. The Dallas Morning News reported last week that Parkland Hospital failed to properly respond to numerous patient grievances. What can these abused patients do about their mistreatment? Unfortunately, their options are severely limited because of tort reform.

Nevertheless, the creative, diligent medical malpractice attorneys at Fears | Nachawati know how to fight for your rights as a tort victim—despite the handcuffs of tort reform.
