Devastating Train Accident in Arlington

An 18-wheeler driver is in a D/FW area hospital tonight after an Amtrak train slammed into his big rig, destroying the truck and putting his health and future at risk.

Train accidents happen more frequently than many Dallas and Fort Worth residents realize. With hundreds of railroads in operation and thousands of miles of track crisscrossing the country, train accidents are bound to happen. While some are the result of dangerous truck or car driving, many are the result of train company failures, such as careless conducting or improper maintenance.

18-Wheeler Accident Puts Fort Worth Drivers at Risk

Drivers in Fort Worth were put in far greater danger than many realized earlier this week when an 18-wheeler driver lost control of his big rig, turning over and spilling 300 gallons of fuel on the roadway as well as thousands of pounds of lumber. With temperatures and risk running high, everyone involved was fortunate that the combustible situation didn’t turn into a dangerous, destructive, and potentially deadly inferno.

18-wheelers carry not only a lot of weight, but a lot of risk – for drivers and other motorists alike. Although they represent only 3 percent of America’s vehicles, they account for nearly half a million accident annually. Whether a trucking accident is caused by driver carelessness, a tire blowout, or a poorly rigged load, these collisions are often serious for everyone involved.

If you’ve been involved in a trucking accident you may need legal advice as to your rights and possible remedies. Fort Worth Driver Crashes into Fort Worth Building

While it’s true most automobile collisions occur between cars, more often than you might suspect a vehicle crashes into a building. In Fort Worth yesterday, that’s exactly what happened. The driver of a pickup truck blacked out, having failed to take the appropriate medication, and slammed into a Fort Worth meeting hall, injuring two victims and destroying the wall of the edifice.

Is the driver liable for the women’s injuries and the property damage to the landowner? This question – important to all accident victims and anyone who might be responsible for an accident – is governed by Texas tort law in general and, in particular, the law of negligence. If the driver’s failure to take medication was due to a careless breach of a known duty, then he may be liable. On the other hand, if the accident truly was accidental, then it’s possible Texas law would not compel him to pay for damages.

Accidents happen. When they happen to you, you may need someone to help you sort out the legal consequences. Fortunately, the team of attorneys and professionals at Fears | Nachawati is prepared to do just that. Find out how we can help you by calling us today. North Texas Hit-and-Run Accident

What is a wrongful death action? For a family in Tarrant County, it could be a meaningful and beneficial legal tool that gives them a chance at justice.

In general, the law provides that only the person who suffers an injury can bring a legal action for damages. Of course, taken to its logical conclusion, this means that a person who suffers an injury and dies or is incapacitated as a result wouldn’t be able to recover. In effect, their claim for damages would die with them. To prevent that obvious injustice, the state legislature has passed the wrongful death statute whereby a loved one may pursue the deceased person’s legal remedies.

For the family of a hit-and-run victim, this statute has new meaning. In the midst of personal tragedy, they have the ability to file a civil lawsuit and may be able to recover damages if the person who struck the man did so negligently or recklessly.

Elevated Highway Elevates Fears, Risk

A Fort Worth accident today underscores just how unique – and dangerous – urban interstates can be. After losing control of his truck, the driver’s truck crashed through a guardrail on Interstate 20, flipped off the highway and landed in a tree near Loop 820 and I-20. Incredibly, the man only sustained cuts and bruises and was promptly rescued.

Elevated highways impose elevated risks on drivers. Although off-the-highway accidents like today’s don’t happen frequently, when they do the effect is often serious – or fatal. Moreover, the presence of elevated highways and the accidents they make worse also raise an important legal question: is the reckless driver responsible for not only the accident, but also the effects of the accident, such as falling off the highway?

Have you been in an accident? The lawyers at Fears | Nachawati know what questions you should ask and what highway dangers you should consider. Talk to us today to learn about your rights and receive your free consultation. Just call us at 1.866.322.6898 or email us at http://www.fnlawfirm.com/contact.cfm. We’re ready to help you.

Plano Man Killed Outside of Houston

A Plano man died last weekend in a fiery wreck in the Montgomery County town of Conroe, outside of Houston. Although his passengers, a woman and two children fortunately survived, the driver died when the vehicle became engulfed in flames.
