Mazda Spider Infestation Forces Recall of 65,000 Cars

In February, Mazda recalled 65,000 Mazda 6 sedans after the car manufacturer learned that yellow sac spiders from the Flat Rock, Michigan assembly plant had infested thousands of cars. The voluntary recall was wise. Although the bites of yellow sac spiders are not as serious as brown recluse spiders, they are serious, causing a painful sting, redness, swelling, blisters and mild illness.

Mazda’s recall, however, failed to return all of the infested cars from the market. Several Dallas-area Mazda 6 owners have noticed yellow sac spiders crawling in their car and the possessions they keep in them. Some have been bitten and all have suffered a significant diminution in the car’s value.

Do you own a Mazda 6? Have you noticed yellow sac spiders in your car? If so, you may have a viable cause of action against the dealership that sold you the car as well as Mazda, the producer of the dangerous product. Dallas-area Teacher Sexually Assaults Student

Amy Schilling, a 33 year-old teacher in Carrollton ISD, was arrested last week on charges of sexually assaulting a juvenile. Carrollton police acted on a report that the R.L. Turner High School teacher had an inappropriate, illegal relationship with a minor.

Teacher-student sexual abuse is a greater problem than many people realize. According to the Counter Pedophilia Investigative Unit (CPIU), 15 percent of students, more than 7 million juveniles, are sexually abused by a member of the school staff during their career. Disturbingly, most cases are never reported, nearly half of all perpetrators are repeat offenders and only 15 percent of teachers are fired.

Has your child been the victim of a teacher’s sexually assault? You should talk to the injury experts at Fears | Nachawati. The teacher should be held civilly as well as criminally responsible, of course. But is the school district also complicit in protecting teachers instead of students from the repercussions of sexual assault? It’s important to raise this question – and many more like them – as you consider how your family should respond. Find justice for your loved ones by calling us at 1.866.705.7584 or sending an email to info@fnlawfirm.com. The consultation is free, and the advice is what you need!

Fraudulent Orthodontists Raise Important Questions About Quality

Investigators recently discovered that Smiley Dental Clinics, which collected nearly $2 million in Medicaid orthodontics (MO) fees in 2010, may have been providing braces to children under age 12 in violation of state law. Smiley Dental isn’t the only firm suspected of this practice. Just last year thirty-four Texas dental clinics collected more than $1 million from Texas coffers by putting braces on children under the age of 12. All told, in 2010 19,000 under-age children, 24 percent of the Medicaid dental population, received braces. The cost to the state was more than $100 million.

These fraudulent practices raise questions not only about dental clinics’ adherence to state law, but also about the quality of care they give to their child customers. If you’re children have braces thanks to Medicaid and you think that your dental provider might have short-changed you on service or quality, talk to the personal injury experts at Fears | Nachawati. Craigslist Moving Contractors Send Clear Message: Read Your Contract!

A couple in Rockwall, Amy Van Vleck and her husband, needed to move out of their old home and into their new one immediately. To help make the move, they hired a moving company, Metro Movers, they found on Craigslist. However, as the Vlecks learned the hard way, they had actually hired scam artists who promised one thing – two loaders, a driver and a truck for $34.95 an hour – but delivered something else entirely. While the Vlecks weren’t paying attention (but before they signed the contract), the men from Metro Movers changed the terms of the agreement, dropping in a $3,700 charge for the plastic wrapping used to protect the Vlecks’ property. The Vlecks signed and, as a result, were bound by the terms of the deal, including the $3,700 charge.

Could the Vlecks have voided the contract on the basis that they were fraudulent induced to sign? Perhaps. Practically, however, they probably wouldn’t have gotten a verdict for several months and in the meanwhile would have been living without their possessions.

So, what’s the solution? Before you sign a contract, read the agreement from the first page to the last. If you have questions, don’t be afraid to ask them. If you need help understanding the agreement, talk to the experts at Fears | Nachawati. Both tort and contract injuries can emerge out of broken agreements. To avoid them, call us at 1.866.705.7584 or send an email to info@fnlawfirm.com. We can help!

Shortage among Claims Adjusters Leads to Suspicious Insurance Reports

In the last month, disasters across the United States are putting a strain on insurance claims adjusters. The Tuscaloosa tornado, the Joplin disaster and, now, major hail damage across North Texas represent considerably more insurance claims than insurers and their claims adjusters are prepared to assess. For instance, North Texans with State Farm filed more than 9,000 auto claims in May, significantly more than in normal years.

Some injured home and car owners feel that the spike in demand is causing the quality of adjustments to suffer. The feeling is reasonable. Poorly trained and inexperienced claims adjusters are being pushed to the front lines. The results can be costly – for you! Make sure that you get the insurance settlement you deserve by calling the experts at Fears | Nachawati. Call 1.866.705.7584 or send an email to info@fnlawfirm.com. We can help!
