Has Negligent Management Put DART Drivers, Passengers at Risk?

The Dallas Area Rapid Transit Authority (DART) held a hearing yesterday in which it attempted to address reasons why three people have died as a result of DART trains and buses in the last three months.

Numerous DART bus drivers attended last night’s hearing, relating disturbing stories about dangerous, reckless, and unprosecuted conduct that has put drivers and passengers at risk of serious injury. Their testimony not only raised questions about the conduct of some of DART’s guests, but also about whether DART management has placed a sufficient priority on the public’s safety.

Sometimes injuries at a business like a restaurant or at a public facility like a train terminal can have multiple causes. The question is not merely whether the person who caused the injury was responsible, but whether the surroundings invited negligent or intentionally harmful conduct. If so, the host, such as DART, may also be responsible.
