Southwest High School Student Dies in After School Fight

Jose Guzman, 16, died suddenly and tragically last week in a street fight with another student. During the fight, Guzman collapsed; he was pronounced dead when he arrived at a nearby hospital soon after.

The student who fought with Guzman, an unidentified 15-year-old, could face civil charges in addition to criminal charges. American tort law’s ‘eggshell skull rule’ makes clear that a tortfeasor (that is, one who commits a tort) is liable for all consequences resulting from his tortuous actions leading to injury, even if the victim suffers a usually high level of damage.

What does the eggshell skull rule mean for your tort liability? What other aspects of tort law do you need to know?
