DART Accident Injures Five, Destroys SUV

In the last decade, the Dallas Area Rapid Transit Authority (DART) has expanded rapidly, providing millions of D/FW residents with improved access to the Dallas community. For the vast majority of Dallas residents, DART light rail has been a great success.

Tragically, for a large and growing number of Dallas residents, DART light rail has been the source of property damage, physical pain and emotional suffering. This week, for instance, five people were injured when a DART train collided with an SUV. This accident, yet another in a long string of personal injuries associated with DART, underscores the fact that risks as well as benefits are connected to DART lines.

DART Worker Injured by DART Vehicle

Early yesterday morning, a DART worker broke his leg when his car backed over him. The worker had stepped out of his car in order to open the HOV gate at Central and I-635.

Exactly who is responsible for the man’s broken leg is an issue that has sparked considerable debate. In situations like this, some experts point to the driver’s failure to set the car’s parking break as an instance of contributory negligence. However, others question whether the car was poorly designed or inappropriately used and suggest that the manufacturer or manager may be at fault.

Have you been injured while working at your job site? Even if you may have contributed to the injury you sustained, that doesn’t necessarily mean that you don’t have a right to recover. Has Negligent Management Put DART Drivers, Passengers at Risk?

The Dallas Area Rapid Transit Authority (DART) held a hearing yesterday in which it attempted to address reasons why three people have died as a result of DART trains and buses in the last three months.

Numerous DART bus drivers attended last night’s hearing, relating disturbing stories about dangerous, reckless, and unprosecuted conduct that has put drivers and passengers at risk of serious injury. Their testimony not only raised questions about the conduct of some of DART’s guests, but also about whether DART management has placed a sufficient priority on the public’s safety.

Sometimes injuries at a business like a restaurant or at a public facility like a train terminal can have multiple causes. The question is not merely whether the person who caused the injury was responsible, but whether the surroundings invited negligent or intentionally harmful conduct. If so, the host, such as DART, may also be responsible.

DART Takes Woman’s Life

DART’s newest Green Line takes thousands of Dallas residents back and forth to work every day. Tragically, however, the Green Line took a life yesterday. According to initial reports, a woman walking near the train tracks in South Dallas was struck and killed by a northbound train. DART suspended train service for two and half hours while it investigated the accident, but resumed the route soon after.

This isn’t the first DART-related casualty this year. And as many Dallas residents remember, several Dallas-area schoolchildren were injured last May when a DART operated escalator malfunctioned, throwing children down the flight of stairs.

Accidents involving public transit may not be as commonplace as automobile accidents, but they happen more than most North Texans realize. The attorneys at Fears | Nachawati represent accident victims, whether they are hurt while driving on the interstate or riding on public transportation.

Commuter Train in Carrollton Claims Pedestrian

A man walking near the train tracks at Frankford Road in Carrollton, a suburb of Dallas, Texas, died when a Denton County Transportation Authority (DCTA) commuter train struck and killed him. The DCTA connects with the Dallas Area Rapid Transit’s (DART) Green Line, which connects much of the D/FW area by light rail.

Today’s accident isn’t the first involving Dallas area trains. Earlier this year, school children on a DART platform were injured when a DART escalator malfunctioned, throwing them down the stairs to the subterranean platform below. Several people were also injured in June when DART and Trinity Railway Express (TRE) trains were responsible for carrying thousands of North Texans to the Dallas Mavericks victory parade in downtown Dallas.

Have you been injured by a Dallas area train? You’re not alone. D/FW trains are responsible for safely transporting paying riders. Personal injury isn’t part of the bargain. Don’t sit on your rights! Justice may be just a phone call away. Trust your legal interests to the expert attorneys at Fears | Nachawati.
