As reported on this blog, this summer a 17-year-old driver rolling through the hills of Wise County killed four of his passengers when he attempted to pass another car during a no passing zone. During the illegal pass, the Fort Worth driver, Danny Ray Nalley, misjudged the speed and proximity of an oncoming Ford F-350 pickup and slammed his Ford Mustang into the truck head-on.
Officials with the Texas Department of Public Safety announced yesterday that their investigation into the crash had revealed that Nalley had a blood-alcohol level of 0.03 at the time of the accident. Whether Nalley had other chemicals in his body remains – and whether Nalley will face criminal charges – remains an open question. In addition to possible criminal charges, Nalley may also a new round of civil allegations based on the revelation that the high school senior had been drinking prior to the accident.
