Drunk Driving Accidents Give Rise to Criminal and Civil Issues

As most Dallas residents know, the law punishes excessive public consumption of alcohol, whether in the form of driving under the influence (DUI), driving while intoxicated (DWI), boating while intoxicated (BWI), or public intoxication. What many people in North Texas don’t realize, however, is that drunkenness can give rise to civil law issues as well as criminal law citations.

If you injure someone while under the influence of alcohol – such as an alcohol-related automobile accident – you could face serious legal and financial claims. In fact, in some situations the criminal law outcome is relatively insignificant in comparison to the civil law result of drunkenness.

The bottom line is that if you’ve been involved in an alcohol-related accident, you should talk to the attorneys at Fears | Nachawati to learn how your rights may be impacted. Who Protects the Rights of CPS Kids?

Child Protective Services (CPS) is an important state agency charged with protecting children from abuse and neglect. Unfortunately, some local offices of this state agency have been failing in their responsibilities.

In San Antonio’s Bexar County, 20 children died last fiscal year while in the care of CPS-authorized caregivers; 15 have perished in just the first eight months of this fiscal year. In Dallas, a CPS investigator was suspended earlier this year amidst allegations of his sexual relationship with a minor.

It’s important to recognize that CPS isn’t the only way that children are protected from personal injury. In some cases, a guardian ad litem can bring a personal injury lawsuit on behalf of the child. If you’re concerned CPS isn’t effectively protecting a child or young person you care about, exploring this possibility may be a step you should consider.

On Highway 67, a well-travelled road near Cedar Hill, Texas, two motorcyclists were killed this weekend when they fell off their bike at a high rate of speed. At this time, it is unclear whether they were wearing helmets or whether other risk factors, such as wet roads, obscured vision, or the presence of alcohol, contributed to the accident.

Dallas Police Officer Kills Pedestrian

Beverly Kirk, a loving mother and grandmother, died this weekend when a Dallas police squad car failed to yield to her as she walked across the street. Although the police officer was travelling at a high rate of speed, there were two important things he wasn’t doing: flashing his lights or blaring his siren. As a result, Ms. Kirk was caught off-guard, trapped in the crosswalk, and struck unexpectedly.

Pedestrians have a right to the road. Unfortunately, even the people who should protect this right – D/FW’s police officers – often disregard it and endanger the rights of walkers, bystanders, and pedestrians. It’s not right; and it’s not permitted under the law.

Have you been injured in an automobile accident, either as a pedestrian or as a motorist? You should talk to the experts immediately. The attorneys at Fears | Nachawati know how to protect your rights and provide for your financial interests. For your free consultation, call 1.866.322.6898 or email http://www.fnlawfirm.com/contact.cfm.

Does the Rowlett Arsonist Face Civil Liability?

Last weekend, Rowlett Police detained a man suspected of intentionally starting several fires since October of last year. With bond set at $100,000 for the suspect, known only as “Reid,” experts suspect that he may be responsible for tens of thousands of dollars worth of damage.

The Rowlett Arsonist case raises an important question: does Reid face civil liability in addition to criminal charges? Yes, if a civil court determines that the suspect did set DFW homes and buildings on fire, he will face financial and legal responsibility for the result of his actions.
