Which Drivers Tend to Be Most Careless?

Academic research shows that not all drivers drive equally well. In fact, some groups of people tend to be considerably more dangerous than others.

On a list of the most careless or reckless drivers, young men are always at top. According to one study, Teen and senior drivers, men aged 16 to 19 are involved in 188 percent more crashes than the average driver. Although somewhat more careful than their masculine counterparts, teenage women aren’t much better, being involved in 134 percent more crashes than the average driver.

What does this mean if a teen driver was involved in your accident? While these empirical findings won’t prove liability in your particular case, they do suggest that it may be time to ask some challenging questions in order to determine whether the teen driver in your accident had both eyes on the road and both hands on the wheel. The academic research suggests that in too many cases, teen drivers don’t.

Shared Decisions, Shared Liability

A woman in Irving was struck by a car and hurt as she was trying to cross Northwest Highway. An investigation of the accident revealed that a man with whom the woman was travelling called out to her, encouraging her to cross the intersection, and directly leading to her accident. He advised her despite being drunk. The question that this situation raises is clear: to what extent was the man responsible for the woman’s injuries?

Shared decisions often result in shared liability. In fact, in many cases these shared decisions can have a significant impact on the damages that negligent parties must pay. Have you or a loved one been injured? Did another person’s decisions cause the accident? Find out how these decisions may have influenced your legal rights by talking to the professionals at Fears | Nachawati today. 18-Wheeler Causes Wrongful Death, Family Receives $4.7 Million

A family in Beaumont, Texas, is finally on the road to recovery after suffering the unexpected and tragic loss of Santos Granja, a beloved husband and father.

Last year, Mr. Granja was resurfacing a road as part of his duties with the Texas Department of Transportation (TxDOT) when an 18-wheeler driver lost control of his big rig. The loss of control was momentary, but the effects were permanent. The 18-wheeler slammed into a nearby car and the car, in turn, struck Mr. Granja and four others.

The Granja family’s wrongful death suit finally concluded this week, with the jury awarding $4.7 million in damages to the family, including more than $2.7 million to Mr. Granja’s bereaved widow. Dedicated attorneys succeeded in bringing justice to Mrs. Granja and her children though skillful practice and a well-honed understanding of how trucking companies shield themselves from liability.

Fears | Nachawati knows how painful the loss of a loved one can be. 18-wheeler accidents can be catastrophic, both to the driver-victim and his or her family. If you’ve been injured in an 18-wheeler accident in the D/FW area, you should contact us immediately. Put our expertise to work for you! 13 Car Pile-Up Delays Dallas Drivers

Yesterday, there was just one word to describe it: incredible. Most drivers go months between seeing just one car accident. To see 13 vehicles dinged, damaged and destroyed vehicles was something that few of the rubberneckers on I-35 will soon forget.

The first accident occurred when a couple of drivers attempting to exit I-35E at Inwood Road collided. The dominos began falling shortly afterward as exiting cars failed to realize that the cars ahead were stopped and had nowhere to go. Some hit the cars that were stopped; others hit the brakes in time. Regardless, everyone was at risk of the next wave of cars rear-ending them, causing another round of accidents. When the wreckage finally ended, 13 drivers were exchanging information and considering how to handle their dinted vehicles. Fortunately – and perhaps equally incredibly – no one was injured.

Fears | Nachawati knows how to handle the challenges of a multi-car accident. Inexperienced attorneys often find it difficult to establish responsibility and, hence, liability when multiple cars are involved. Fortunately for you, our skilled and experienced professionals are prepared to deal with exactly this situation. If you’re recovering from a pile-up like the one yesterday on I-35 near Inwood Road, you should contact us. Dallas IHOP Accidentally Gets a Drive-Thru Window

Earlier this week a Ford Expedition backed into – and through – the exterior wall of a local IHOP. Post-accident images reveal a gaping hole in the side of the building!

It’s true: the vast majority of automobile accidents happen on the road and between the lines. However, that’s not where all accidents occur. Every year there are hundreds of accidents – everything from fender-benders to fatalities – that occur when cars hit roadside obstructions, such as mailboxes, fences, road signs, and buildings.

How much do these accidents cost? Are the damages covered by the driver’s automobile insurance? Can decisions by the property owner impact the extent of the driver’s liability? These are the right kinds of questions to ask, but the most important question is who should answer them?

For some of the most experienced, well-trained, and courtroom-tested attorneys in Texas, contact the accident specialists at Fears | Nachawati. Pickup Passenger Dies in Dallas Truck Bed Accident

You probably see it almost every day on your commute: people riding in the bed of a pickup truck. If you own a truck, it makes sense. You need to carry people around, and the bed stays empty most of the time. Why not have a couple of friends ride in the back?

A grizzly accident in Garland, Texas, earlier this week provided a reminder as to why it’s against the law in many communities to drive a pickup with passengers in the bed. While driving down LBJ Expressway near Northwest Highway, a man fell from the back of his friend’s pickup truck, landing on the highway. Tragically, the fallen passenger was then run over by several vehicles. By the time traffic finally slowed, the man had already sustained catastrophic injuries and had died at the scene.

Is the driver responsible for his passenger’s injuries? Would you be responsible if this happened to you and your friend? Fears | Nachawati can answer these important legal questions. We understand when legal liability attaches to individuals and how you can defend yourself against spurious claims. If you’ve been in an accident, you should contact us immediately! Fair Park Rave Takes Second Victim

Last weekend, the Electric Daisy Carnival at Fair Park, a rave attended by several thousand young North Texans, made headlines when a teen from Argyle, Texas, died unexpectedly. Now, the Electric Carnival in under increased pressure after the Dallas Police have reported a second man, 22-year-old Kyle Haigis, died after he ran onto the highway and was hit by an 18-wheeler. Initial reports indicate that Haigis died as a result of a hostile reaction to an illegal drug, ecstasy. Some now believe that the host of the rave, Insomniac Events, might have liability stemming from their role as the organizer of the event.

Want to know more about event liability? Are you worried about the effects of drugs on your children? Illegal drug use – and abuse – is an important issue for many interested parties. Premises Liability and Safety Concerns Lead to UNT’s Bee Eradication

As incredible as it sounds, for the better part of two decades the University of North Texas campus has been home to more than 3,000,000 bees. Living in colonies in a brick wall of the school’s Radio, TV and Film building, the bees – some of which have become aggressive in recent years – threatened thousands of students who walked on nearby sidewalks. For people allergic to bees, a sting can be a serious medical issue.

The legal concept of premise liability makes the owner of a property – such as the University of North Texas – responsible for any harm that befalls guests on the property. In the case of North Texas’s 3 million bees, anyone injured by bee stings probably would have a viable legal claim against UNT and its decision to host the injury-causing insects.

Have you been harmed by the dangers imposed by your neighbors, employer or school? If so, you should contact the personal injury attorneys at Fears | Nachawati immediately. For a free consultation, call at 1.866.705.7584 or send an email to info@fnlawfirm.com.

LBJ Freeway Expansion Threatens Driver Safety

In the long-run, the LBJ Freeway expansion will be beneficial. As one of the most congested roadways in the nation, I-635 is in dire need of the $2 billion renovation that began last weekend and is anticipated to take five years. However, the tragic reality is that the next five years will include dangerous construction and risky driving. Both workers and passengers will likely suffer injury as a result of the expansive project and the sheer volume of traffic that will pass through the busy area.

If you’re involved in an accident on LBJ while its under construction, you should speak with the injury experts at Fears | Nachawati. While negligence is often the cause of traffic accidents, improper roadway construction and renovation may be a contributing factor, too. It’s important to consider all of the causal factors when assessing an accident and apportioning of liability. For a free consultation, call at 1.866.705.7584 or send an email to info@fnlawfirm.com. Does the Rowlett Arsonist Face Civil Liability?

Last weekend, Rowlett Police detained a man suspected of intentionally starting several fires since October of last year. With bond set at $100,000 for the suspect, known only as “Reid,” experts suspect that he may be responsible for tens of thousands of dollars worth of damage.

The Rowlett Arsonist case raises an important question: does Reid face civil liability in addition to criminal charges? Yes, if a civil court determines that the suspect did set DFW homes and buildings on fire, he will face financial and legal responsibility for the result of his actions.

If Someone Fell in Your Home or Office Would You Be Liable?

Premises liability is an important legal concept. Courts have found that property owners have an obligation to ensure that their land is free from hazards and dangerous conditions. Despite this standard, many property owners are unaware or indifferent to their legal liability for the premises they control. Premises liability can arise from any number of hazardous conditions, including cracked steps, uneven pavement or flooring, ice, wet floors, leaks, insufficient lighting, lack of warning signs and lack of security.

You are responsible for the condition of your home and office. If you’re concerned about the extent of liability which you might face in the event of an accident occurring on your premises, you should contact the injury experts at Fears | Nachawati immediately.
