Important Legal Doctrine at Issue in Accident near Apartments?

The phrase “respondeat superior” may sound Greek to you, but this Latin word can have important legal consequences. In short, the doctrine of respondeat superior means that an employer may be held responsible for the careless or reckless decisions of its employee.

Is this legal doctrine at work in the recent accident that occurred near Dallas’s Oasis Apartments? It could be. According to reports, last week a resident of the complex ran after a tow truck that was carrying away his car, presumably for committing a parking infraction. Whatever the reason, what happened next was horrifying: the tow truck driver ran over the man chasing after him – and drove away from the accident scene.

Two questions are particularly important in this case: first, did the tow truck driver act with reasonable care and second, was he acting with the scope of his employment? If the first answer is “No” and the second answer is “Yes,” the facts may be sufficient to trigger the doctrine of respondeat superior – and the employer’s liability.

Have you been in an accident with a commercial driver, such as a delivery person, tow truck driver, or 18-wheeler driver? The doctrine of respondeat superior may be at work in your case, too. Which Drivers Tend to Be Most Careless?

Academic research shows that not all drivers drive equally well. In fact, some groups of people tend to be considerably more dangerous than others.

On a list of the most careless or reckless drivers, young men are always at top. According to one study, Teen and senior drivers, men aged 16 to 19 are involved in 188 percent more crashes than the average driver. Although somewhat more careful than their masculine counterparts, teenage women aren’t much better, being involved in 134 percent more crashes than the average driver.

What does this mean if a teen driver was involved in your accident? While these empirical findings won’t prove liability in your particular case, they do suggest that it may be time to ask some challenging questions in order to determine whether the teen driver in your accident had both eyes on the road and both hands on the wheel. The academic research suggests that in too many cases, teen drivers don’t.

Dallas Driver Slams into Local Mall

It may sound absurd, but Friday morning a Dallas driver drove his truck into Southwest Center Mall, slamming into interior fixtures and finally coming to rest in a sporting goods store. To make matters more bizarre, the man was driving naked – and decided to dress himself in clothes he found after his truck came to a stop in the store’s entryway.

Admittedly, this accident is unusual. However, the risk that today’s events suggest – that careless or reckless drivers might inadvertently slam into a building or home – is far from absurd. In fact, virtually every month a driver somewhere in North Texas loses control of his car and careens into a home or commercial building.

What should you do if an out-of-control driver damages your property? Fortunately, the law is on your side. You just have to know what steps to take. Your first step should be to contact the professionals at Fears | Nachawati. With years of automobile accident experience and dedicated expertise, we’re prepared to help you. Lake Liability: No Guard on Duty

With summer coming and the weather getting warming across North Texas, residents of Dallas, Fort Worth, and the surrounding suburbs will head to D/FW’s many lakes to enjoy in watersports like boating, fishing, water skiing, and sailing. Although heading to the lake is a great way to relax, it’s easy to fall into the deep end of legal trouble.

Every summer, hundreds of North Texans experience property damage, personal injury, and even death as the result of reckless behavior on area lakes like Lake Ray Hubbard and Lake Lewisville. Just like you put your life in your hands when you swim without a lifeguard on duty, you put your legal rights and interests at risk when you step on a boat. Be safe, take precautions, and know what to do if you sustain property or personal injury.

The attorneys at the Dallas firm of Fears | Nachawati know how to defend your legal rights if you’re injured on a lake this summer. With years of experience – and many Texas summers – under our belts, we know how to advise you of your options and protect your interests. If you’re in an accident this summer, give us a call. Police Officer Injured in Hit-and-Run Accident

Tragically, a police officer in Mesquite was injured today when a reckless driver struck him with his car. The accident was the result of an extreme kind of negligence: the driver, fleeing an earlier wreck involving an SUV, lost control of his car, striking the officer’s car as the official was in the midst of a customary traffic stop. Although the police officer was taken to the hospital, initial reports suggest that he is recovering quickly.

Fears | Nachawati knows how to protect victims of reckless drivers. Kaufman Accident Raises Important Questions about Driver Safety

Several drivers and a passenger, including a child, were injured today in the Dallas suburb of Kauffman, Texas, when a sedan and pickup truck collided. Accidents happen every day in North Texas, but they aren’t necessarily accidental. You may not realize it, but reckless drivers who make irresponsible decisions – such as texting while driving, speeding, and driving under the influence of alcohol and drugs – are responsible for the injuries they cause. Taking legal action may be the only way to protect your rights!

If you or your loved one have been injured in an automobile accident, it may be time to contact the personal injury experts at Fears | Nachawati. The Legal Consequences of Driving High

Last week, Thomas Harper drove his SUV into a pickup truck and shot a would-be Good Samaritan who attempted to help him after the accident. Despite the efforts of medical personnel, Harper’s handling of his car and his firearm produced two fatalities. An investigative report released this week revealed a tragic contributing factor: Harper was high on marijuana during the accident and shooting.

From a public safety standpoint, the message is clear: don’t smoke and drive. As a tort law reality, however, the issue of how the law treats people who are under the influence of a narcotic when they commit a reckless act is more complicated than it might first appear. For instance, victims of such carelessness and their families will want to establish the extent to which drug use caused an act versus merely increased the probability that such an act would take place.

Complicated evidentiary problems accompany any drug-induced wrongdoing. If you’ve been the victim of a drunk or high driver, you need a legal team capable of sorting out these challenging factual and legal matters. Fortunately for you, you’ll find the talented, experienced, and dedicated advisors at Fears | Nachawati. Call us today!
