Arlington police officer killed in line of duty

Arlington police officer Jillian Michelle Smith was tragically killed in the line of duty earlier this week. Officer Smith was responding to a domestic violence call when she was shot and killed. She is credited with using her quick thinking, her body and ultimately her life to save an 11-year-old girl. The child and Officer Smith were caught in fire directed by the child's father to the child's mother. After killing the child's mother and Officer Smith, the father, Barnes Samuel Nettles, shot and killed himself.

25 gas plant workers hospitalized

Twenty five gas plant workers were sent to the hospital for carbon monoxide poisoning after the plant they were working at suffered a leak, while 20 others were treated at the scene. The incident occurred in Freeport, New York, at the LaMar Plastic Packaging Company. Indoor readings of carbon monoxide reached dangerous levels. Bedford hospital employees assaulted by patient

Two employees of Texas Health Harris Methodist Hospital Hurst-Euless-Bedford in Bedford were recently assaulted by an unruly patient. The employees alerted authorities to the dangerous situation. The patient remained violent and an officer had to Taser him so that hospital workers could restrain him. The conditions of the employees is not presently known, but they are expected to survive their injuries and recover fully.

Parker County sergeant dies after wreck

A Parker County Sherriff's Office sergeant has died as a result of injuries sustained in a wreck in Springtown. Authorities say that the sergeant was stopped at a red light on Texas 199 when he was hit from behind by a vehicle traveling 50 to 60 miles per hour. The sergeant's car was pushed into the vehicle in front of him. He survived the immediate accident but died several days later as a result of his injuries.

One man has died as a result of a wall collapse at a sand plant in Wisconsin. Garland officer injured by suspected drunk driver

A Garland police officer was injured on the George Bush Tollway near Holford Road when he was hit by a suspected drunk driver. The officer had a suspect in his custody at the time of the accident and was standing outside of his patrol car when he was struck by another car. His squad car was also struck. Justice sought for delivery driver murdered on the job

Tarrant County prosecutors recently announced that they would seek the death penalty in the trial of a man accused of murdering a delivery driver in a convenience store robbery in Fort Worth. Box truck driver injured in North Richland Hills accident

A box truck driver was among those injured in a multi-car wreck in North Richland Hills. Authorities say that a driver failed to stop for a stoplight and slammed into the box truck and another vehicle. XTO gas leak threatens early morning workers

A vapor cloud was emitted from a north Fort Worth gas well site operated by XTO Energy early Monday morning. The cloud originated from a pressurized pipe that was leaking natural gas. A Fort Worth Independent School District bus driver was injured today in a wreck. A maintenance man was tragically shot and killed while at work in an apartment complex in far north Dallas. Delivery driver hurt in massive pileup in Arlington

Ten people, including a delivery truck driver, were injured in a massive 32 car pileup in Arlington today. Authorities say that the incident began when a car was rear-ended when it attempted to exit Highway 360. The impact of the crash caused the car to spin into traffic. A firefighter was injured when battling a blaze at an apartment complex in far north Dallas Friday morning. A security guard was injured in a scuffle at a Fort Worth strip club that ended with one patron being shot four times. Authorities say that a fight broke out early Friday morning in the parking lot of the Silhouette Cabaret club on Camp Bowie. Two groups of people were fighting in the club when they were thrown out. The groups continued fighting in the parking lot, and a security guard was injured in the melee. A man who was severely burned in a West Texas oil field has died. Authorities say that the man, Abel Garcia, was engulfed by flames when leaking natural gas ignited. One person was injured in a north Fort Worth bank robbery Wednesday. Authorities report that the suspect robbed Pinnacle Bank on Western Center Boulevard. The suspect approached a teller, demanded money and displayed a handgun. Later, the suspect revealed a second handgun. Employees and customers were ordered around by the suspect, who later fired about a dozen rounds inside the bank. Nobody was shot, but one bank employee was injured by falling debris believed to be a result of the shooting.

Fugitive hits police officer with car while trying to escape

A veteran Fort Worth police officer was injured this week when a suspect hit him with a car. A fugitive was behind the wheel of a Ford Taurus when he struck a surveillance vehicle, a marked patrol car and finally the officer while running from police. Convenience store clerk assaulted while thrwarting robber

A convenience store clerk was injured in an early morning attempted robbery today. Authorities say that the suspect entered the Kwik Stop on Martin Luther King Boulevard near I-45, grabbed the store's cash register and ran away. The clerk armed himself and chased after the suspect. The suspect then threw the register at the clerk, but kept the drawer containing the cash. The clerk caught up with the suspect and was hit with the drawer several times while recovering it from the suspect. The suspect was killed when the clerk's gun went off during the struggle. The clerk, who has not been identified, received treatment for his injuries.

A farmworker was killed when a large hay bale fell on him. The man was working in a pasture southwest of Mansfield, off of County Road 520. A man was shot to death Thursday evening while making repairs to the limousine he drove for a living. The man, Brandon Nathan Campbell, 26, was working on the brakes of his vehicle in the 400 block of East Ramsey Avenue when a man drove up in a white compact car, got out of his car wielding a pistol, and shot Campbell. Gulf oil platform fire injures 13, all survive

An oil platform in the Gulf of Mexico caught fire last week. Thirteen workers were aboard the shallow-water platform when the incident occurred. The rig is located approximately 100 miles south of Louisiana's Vermilion Bay. 5th man arrested in connection with fatal shooting of convenience store clerk and delivery driver

A 5th man has been arrested in connection with a fatal shooting of a convenience store clerk and also a delivery driver that occurred earlier this year. Video from the crime shows that the clerk, Daniel Rojas-Torres, gave the criminals a bag of money that had been hidden in a freezer but was eventually dragged to the back of the store where he was forced to sit in a chair and then shot in the head. Jerry Burnett, a delivery truck driver who was stocking shelves at the time the robbery occurred, was also shot and died from his injuries.

Woman claims God told her to kill co-worker

A woman told Dallas police that God told her to kill her longtime co-worker this week at a Carrollton pest control business. Theresa Gail Robbins walked into her workplace this week and shot Greg Brasch once in the chest with a handgun. Brasch was taken to Baylor Medical Center where he was pronounced dead. Five people were hospitalized in intensive care after an ammonia plant leak at an Alabama chicken freezing plant earlier this week. EMT killed in carbon monoxide accident

One Emergency Medical Technician (EMT) was killed and two of the victims co-workers were hospitalized after being overcome by carbon monoxide while on duty in the east Texas town of White Oak. Authorities believe that the carbon monoxide came from a generator that was left running on an ambulance. The ambulance was parked in a closed bay when the accident occurred. OSHA is investigating this accident. No carbon monoxide detector was installed in the building because the building itself runs solely on electric. The driver of a tractor-trailer was killed earlier this week when his truck was struck by a train in Liberty County, near Houston. Two Arlington-based flight instructors and one other person were killed when the single-engine plane they were riding in crashed in Hood County this week. Lancaster police officer killed in line of duty

A Lancaster police officer was killed in the line of duty this weekend. Officer Craig Shaw, a five-year veteran of the Lancaster police force, was shot and killed after he was called to the scene of an apartment complex in the 900 block of River Bend Drive near West Pleasant Run Road in southern Dallas county. The shooter, David Brown, Jr., had previously shot and killed a man before Officer Shaw arrived. Officer Shaw attempted to keep Brown from fleeing the scene when Brown opened fire on him. 2 workers killed in natural gas explosion

Two workers were killed in a natural gas explosion in the Texas panhandle. Several other workers were hurt in the blast. An gas pipeline exploded in Johnson County today, killing three and injuring at least eight. The dead and injured include individuals who were working on the pipeline when the blast occurred. Witnesses reported that they heard a loud explosion and then saw a large cloud of smoke or steam. The injured have been taken to hospitals in Johnson, Somervell and Hood counties. The blast occurred approximately 50 miles south of the DFW Metroplex.

Man dies at drill site in NW Tarrant County

A 25 year old worker was killed at a drill site near Eagle Mountain Lake in NW Tarrant County. The man, Silverio Rubio-Loredo, was working on the west shore of the lake and east of Farm Road 730. Teachers and students sickened by gas leak at school

Two teachers and five students were sickened by a natural gas leak at Crowley Ninth Grade Campus. The gas leak occurred in a science classroom and came from a line designated for use by a Bunsen burner. A man's arm was severed from his body in what one emergency responder called a "traumatic amputation" at a Fort Worth meat plant. Acid spill in Fort Worth injures four

Two construction workers and two officers were injured, and a firefighter was treated for heat exhaustion, after a release of acid fumes at a Dannon Co. yogurt plant in Fort Worth. Firefighters closed streets around the plant for hours while the spill was contained and cleaned up. One construction worker, one officer and the firefighter were taken to area hospitals for treatment. Investigators say that a tank containing a diluted form of peracetic acid, a substance used to clean machinery in the plant, came into contact with some type of organic substance. The reactions created vapors that escaped through a lid on the tank.

On-duty Dallas police officer injured in hit-and-run

An on-duty Dallas police officer, in uniform and driving in a marked police car, was injured Sunday morning in a hit-and-run accident. The accident occurred on C.F. Grapevine employer fined by OSHA for health & safety violations

The Occupational Safety and Health Administration recently fined Grapevine-based Fore Machine Co. more than $70,000 for failing to adequately protect its workers from potentially harmful exposure to lead. Fore is a machined parts manufacturer, and the alleged violations occurred at its Haltom City facility. Two workers hurt at industrial site in Fort Worth

One worker was burned and another was injured Tuesday in a fire at Texas Industrial Scrap Iron and Metal in north Fort Worth. The injured workers were working outside cutting metal containers with a torch when some of the materials ignited. Authorities believe that the containers may have had some kind of flammable contents.

One man suffered second- and third-degree burns over the right side of his body. The other man's hand was injured while battling the fire. The man who was burned was taken to Parkland Hospital in Dallas.

North Richland Hills Chase Bank employee hurt in robbery

A Chase Bank employee was injured today when he attempted to stop a robbery at the bank's North Richland Hills branch.

The robber posed as a Chase Bank employee. He had what appeared to be a Chase Bank identification badge in his possession. He started his crime by asking to speak to the branch manager. At some point the robber gained access to an undisclosed amount of money, which he grabbed and ran away with. A real employee was injured when he attempted to thwart the robber's escape. Fortunately the employees were minor.

The robber is still at large. Witnesses describe him as a white male in his 30s, medium height, medium build, dressed in Chase Bank attire.

Statistics on Texas on the job fatalities

A recently report has analyzed on-the-job fatalities in Texas. Nationally, there are about 5,000 work-related fatalities per year, about 500 of which involve workers in Texas.

The data show that transportation incidents are the leading cause of about 45% of Texas work fatalities. Assault and violent acts account for nearly 20% of deaths on the job. Fires, explosions (such as the recent explosion in the gulf that caused the Gulf Oil Spill), exposure to harmful substances, electrocution, and exposure to caustic or noxious substances are also major causes of work related deaths in Texas.

More motor vehicle workers are involved in fatal accidents than any other worker, and most of those fatalities were due to transportation incidents. Construction workers are also frequently killed on the job. Approximately 94% of work fatalities are men, while only 6% are women.

Dallas sanitation worker found dead at landfill

The body of a Dallas sanitation worker was found yesterday at the McCommas Bluff Landfill in Dallas. Police identified the man as Roderick Terrell, a brush truck driver.

Mr. Terrell was on the job at the landfill when he was last seen. Coworkers discovered his empty, still running truck about two hours after he checked in at the landfill to unload his truck. A search for Mr. Terrell then began. His body was found the next day.

Authorities believe that this is the first on-duty fatality at the landfill. The medical examiner is determining a cause of death for Mr. Terrell. Authorities do not suspect foul play.

A memorial service for Mr. Terrell will be held in the coming days.

Census worker death toll: Six

Six census workers have died this year on the job so far. Three of the workers were in Texas, including two workers in Lubbock who were killed in a traffic accident involving a tanker truck.

The Census Bureau has not released many details regarding the deaths of its workers. The bureau has increased its training for its employees, to help them stay alert of possible dangers on the job. Census workers will work in teams in areas that are considered particularly high risk.

In the 2000 census, 13 workers were killed in traffic accidents and one worker was attacked by a dog.

Three workers injured in explosion and fire at Medical City Dallas Hospital

A recent explosion followed by a fire injured three workers at Medical City Dallas Hospital. Investigators believe the incident occurred when a contractor attempted to transfer power, causing an electrical short. The explosion occurred in an outbuilding near the hospital's loading docks. Early estimates are that damages to the property total $300,000. Two of the injured workers were airlifted to Parkland Memorial Hospital, while the third worker was treated at Medical City.

Employers liable for distracted driving?

A recent study by the Virginia Tech Transportation Institute showed that a truck driver is more than 23 times more likely to be involved in an accident if the driver is texting while driving. Asbestos found in local Kroger grocery

Workers recently uncovered asbestos in a Kroger grocery store in Denton. The asbestos was located in a floor, and workers uncovered it while tearing out tile. The store was closed to customers while the asbestos was removed.

Asbestos is a mineral that can be worked into long, flexible fibers. Decades ago it was a popular addition to products such as floor tiles, siding and insulation. Its use has been outlawed, since inhalation of asbestos fibers can cause lung cancer, mesothelioma and other disorders. Asbestos products remain installed in many homes, businesses, schools, manufacturing facilities and other buildings.

OSHA cites contractor for safety violations at Cowboys Stadium

The Occupational Health and Safety Administration has cited Birdair, Inc., a roofing subcontractor, for safety violations related to a December incident where two maintenance workers slipped on an icy roof and fell. The workers slid about 260 feet down the domed roof, until they caught a gutter. One worker broke his leg and suffered head and chest trauma, and the other suffered a back injury.

OSHA proposed $45,000 in penalties for two violations related to safety equipment and training. Although the workers were wearing fall protection gear, they were not properly tied off.

Bullet from apparent suicide enters Starbucks, threatening employees and customers

A bullet Thursday passed through a man's head and soared through a Starbucks drive-up window in Grapevine. The shooter, who later died from his wounds, was sitting on his front porch when the bullet was fired. The bullet entered the Starbucks through the open window. After whizzing past employees and customers, including one man who reports being within one foot of the line of fire, the bullet eventually lodged itself into a bathroom wall. Fortunately, it appears that no employee or customer was physically injured in this bizarre incident.

Adam Lopez, a tow truck driver, was fatally injured Wednesday when he was struck while trying to remove a vehicle from I-20 in Eastland County. Mr. Lopez was hit by a pickup truck. He was taken to John Peter Smith Hospital in Fort Worth where he died a few hours later.

Crash of three semis leaves one dead

Three semis and two pickup trucks were involved in a five-vehicle wreck near Cleburne very early Saturday morning. The wreck left the highway shut down hours, and debris was strewn for a quarter mile stretch along Highway 67.

Police say that one semi clipped an oncoming tractor-trailer, forcing the first semi into the path of another big rig. The driver of the first semi was killed instantly. One of the surviving tractor-trailer drivers was taken to the hospital. The drivers of the pickup trucks did not require immediate medical attention.

Texas construction worker killed after building collapses

A Texas man was killed in a construction site accident at Palestine High School on Thursday morning.

The work accident victim, a 26-year-old man whose name has not been released, was working under a portable building which had recently been moved to the PHS campus.

Preliminary investigations into the construction site accident indicate that the ground was saturated because of recent rainfall. As a result, the portable building shifted and fell off of the supporting jacks underneath it, killing the man working beneath the building.

The floor of the portable structure had to be cut in order to reach the victim who was trapped under the building, according to police. Once the work accident victim was reached, he was apparently already deceased.

The victim was pronounced dead at the scene by Pearce Gary Thomas, the Anderson County Precinct 1 Justice of the Peace.

Construction worker killed on the job at Texas work site

A 25-year-old worker was killed at a construction site in Texas Friday afternoon when he was pinned to a sewer main after the walls of the trench he was working in collapsed.

The construction site accident victim was Mexican national Rigoberto Tovar. Around noon on Friday, Tovar was working to install a storm sewer line located approximately 10-feet underground at an intersection in Alamo City, Texas.

At the time of the workplace accident, Tovar was standing in a 6-foot-deep trench. The earthen walls suddenly gave way, knocking Tovar into the sewer main. He was killed instantly.

Tovar was working for M Construction of McAllen when the work accident occurred. The company is a private contractor that was hired by the city of Alamo to complete the road expansion project.

An investigation into the accident is being conducted by OSHA to determine whether all proper safety protocols were followed.

3 Texas men injured in construction site accident

An accident at a Texas construction site on Thursday afternoon left three workers injured. Two were sent to area hospitals.

At the time of the accident, the three workers were setting decking on tresses. The job site was located at Weatherford Ridge Shopping Center. The workplace accident occurred a when a load of plywood shifted, knocking over the tresses.

According to Weatherford Fire Chief George Teague, all three men were injured when the tresses fell.

One suffered only minor injuries, but another worker suffered head injuries and a compound wrist fracture. He was taken to Weatherford Regional Medical Center by air ambulance. The third worker, who was complaining of back pain, was taken to the same hospital via ground ambulance.

Teague says that all three of the men were conscious and talking when rescuers arrived on the scene.

Fort Worth, Texas, worker killed in workplace accident at Dannon Yogurt plant

On February 13th, a worker at Dannon’s yogurt plant located in the medical district of Forth Worth, Texas, became trapped in some machinery. The victim, Tri Tran of Fort Worth, suffered head and chest injuries in his workplace accident. He died six days later as a result of those injuries, according to a statement released by the Tarrant County medical examiner’s office.

Tran worked for the plant as a maintenance mechanic. He became pinned near the ceiling by a scissor lift, which is an electronically controlled platform that’s used for changing light bulbs.

At this point, it remains unclear whether the workplace accident was caused by an equipment failure or some other factor.

OSHA has begun its investigation into the fatal workplace accident, but, says agency spokeswoman Elizabeth Todd, no details will be released while the investigation is ongoing.

According to Dannon spokesman Michael Neuwirth, the company does not have conclusive evidence about what happened. The company is, along with OSHA, conducting an investigation into what caused Tran’s entrapment and blunt force injury.

The medical examiner’s office has said that there is no evidence that foul play was involved in the work accident.

Texas man files lawsuit against employer after developing skin problems on the job

A Texas dishwasher has asked an appellate court to reinstate his work injury lawsuit against Dowlen Oaks Retirement Center.

In his work injury lawsuit, plaintiff Gary Stallworth alleges that his skin problems are a result of his employer failing to adequately train him in how to properly wash dishes. The original Texas work injury lawsuit was filed in November of 2007.

Stallworth alleged that he began to experience a skin problem when washing dishes for Dowlen Oaks on November 28, 2005. According to Stallworth, he was told by doctors that his skin condition was caused by the way he was washing dishes.

A year after the lawsuit was filed, proceedings were halted as Dowlen Oaks and Stallworth agreed to enter into arbitration. In July of 2009, Dowlen was granted a no evidence motion for summary judgment by the arbitrator.

As a result of the unfavorable outcome, Stallworth is seeking to enter out of arbitration and get back into civil court.

Stallworth’s suit accuses Dowlen Oaks of negligence. He is seeking damages for lost wages, medical expenses, mental anguish and physical pain as well as compensatory damages.

Texas construction worker injured in 20-foot fall

A Texas construction worker was severely injured Wednesday morning after falling into a 20-foot, uncovered shaft at San Antonio college.

The name of the construction site accident victim has not yet been released. However, it has been reported by Derrick Patten, deputy chief for Alamo Colleges District Police Department, that the man was working at the Nail Technical Center at around 7:45 a.m. when he fell into the shaft.

The workplace accident victim was still conscious when taken to Brooke Army Medical Center. He had suffered a leg injury and severe head injuries.

The hole into which the construction site accident victim fell drops onto a lower concrete platform where the mechanical equipment is stored.

The victim was pulled out of the hole by the San Antonio Fire Department’s technical rescue team.

At this time, it remains unclear why the hole was open and not covered, as it usually is, by a metal grate. It is also unclear whether the worker was wearing a hardhat.

When can I bring a personal injury claim for an on-the-job injury?

If you are injured in a workplace accident and your employer subscribes to workers’ compensation, then workers’ compensation benefits may be your only recourse. However, this is not always the case. There are times when an injured employee, even one who is covered by workers’ compensation, can still bring a personal injury claim after a workplace accident.

Here are four common situations where an injured worker may be able to bring a personal injury claim in addition to a workers’ compensation claim:

1. Your injury occurred on someone else’s property: In the course of their duties, employees sometimes have to perform work on remote job sites. For example, a delivery person spends much of their work day at places other than their employer’s premises. If you are injured in a workplace accident that occurred somewhere other than your employer’s place of business, then you may be able to bring a personal injury claim against the owner of the property where you were injured.

2. Your injury is the result of an intentional tort: If your employer had an actual intent to harm you, then you are not barred by workers’ compensation from bringing a personal injury claim directly against your employer.

3. Your injury was caused by a third party on your employer’s premises: Sometimes an employee’s injuries are caused by a third party who happens to be on their employer’s property. For instance, a worker could be hit by a delivery truck dropping off supplies or struck by an object dropped by a contractor performing maintenance work. In those cases, the injured worker may be able to pursue a personal injury claim against the third party and perhaps even the third party’s employer.

4. Your injury was caused by a malfunctioning or defective product: If you were injured by a tool or piece of equipment that was unreasonably dangerous or defective, then you may be able to bring a product liability suit against the manufacturer of that tool or piece of equipment. A product liability claim, in these cases, could be brought in addition to a workers’ compensation claim.

Worst job in America: Oil rig and gas pipeline worker

According to a story recently published by Forbes magazine, oil rig and gas pipeline workers have the worst job in America for 2010.

Texas worker files lawsuit after suffering on-the-job injury at grocery store

A Texas man has filed a work accident lawsuit against his employer after he was injured while on the job at a grocery store.

Donato Arce, who does not specify how he was injured, says he was hurt while working for Retail Investors of Texas, which does business as Mercado de Familia.

Because Mercado de Familia does not carry workers’ compensation insurance, the company is responsible for all of his injuries, says Arce.

Damages cited in Arce’s work accident lawsuit include medical expenses, pain and suffering, mental anguish and lost income.

According to the lawsuit, Mercado de Familia is responsible for Arce’s injuries because of the company’s knowledge of the dangerous condition on its premises and the unreasonable risk of harm that it posed to employees. The lawsuit further alleges that the company failed to rectify the dangerous condition and failed to reduce the risk of harm to Arce.

Texas family awarded $10 million in damages for wrongful death of crane operator

A Louisiana oilfield-construction company has been ordered to pay $10 million in damages to the family of a Texas worker who was crushed to death in a crane accident.

The victim was Adrian Flores, a 50-year-old crane operating who was working for Gulf Marine Fabricators near Ingleside, Texas. The company is a subsidiary of Houma, Louisiana-based Gulf Island Fabrication. Gulf Island Fabrication builds vessels and structures that are used in the marine, oil and gas industries.

Texas district court judge Joel Johnson awarded Flores’ wife and six children slightly more than $10 million dollars for Flores’ wrongful death as well as the family’s pain and suffering. In doing so, he reduced the $11.1 million verdict awarded by a San Patricio jury in January.

The workplace accident occurred in April of 2008 when Flores, along with three other crane operators, was attempting to lift a 1,200-ton piece of offshore platform with a crane.

At some point, a boom on Flores’ crane became loose, which threw the load off balance and onto the crane’s cab.

According to trial testimony, Flores, who had worked at the same job site for 10 years, was considered to be one of the best crane operators there.

An attorney for Gulf Island Fabrication says the company plans to appeal the judgment.

Texas worker files lawsuit over injuries suffered in crane accident

A Texas man is suing after being struck by the load of a moving crane while working at BP’s Texas City refinery.

The plaintiff, Francisco Cantu, is suing BP Products North America Inc. and Maxim Crane Works L.P. over the October 2008 workplace accident.

According to the lawsuit, a load being moved by a crane swung around and struck Cantu. Cantu, as a result, became trapped between the bundles and the tarp support.

The suit alleges that the crane accident was caused by improper crane operation, improper lifting techniques, improper rigging and improper supervision.

Cantu states that he was forced to undergo back surgery as a result of the crane accident and needs additional medical care for his head and neck.

Cantu’s crane accident was no isolated incident, according to his lawsuit, which states, “More than five years ago, BP management identified lifting incidents as one of the major safety issues at the BP Texas City plant yet nothing has been done to correct these problems.”
